IMPORTANT NOTICE & ACKNOWLEDGMENT

PLEASE READ THIS DOCUMENT CAREFULLY BEFORE SIGNING. BY SIGNING THIS AGREEMENT, YOU ARE WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE TIMEZONE ENTERTAINMENT PVT. LTD., ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, FUN SQUAD MEMBERS, AGENTS, AND VENUE PROVIDERS (TOGETHER, THE “RELEASED PARTIES”). BY SIGNING, YOU CONFIRM THAT YOU HAVE READ AND UNDERSTOOD THIS AGREEMENT, HAVE HAD THE OPPORTUNITY TO ASK QUESTIONS, AND ARE SIGNING VOLUNTARILY.

1. ASSUMPTION OF INHERENT RISKS

I, the undersigned Participant (or Parent/Legal Guardian on behalf of the minor participant[s] listed below), understand and acknowledge that participating in Gel Blaster activities involves inherent risks, including but not limited to:

• Physical impact from small hydrogel projectiles (Gellets) fired at calibrated velocities (approximately 180–200 fps, subject to normal equipment variation), which may cause stinging, skin irritation, redness, welts or bruising and, in rare cases, more serious injury.
• Risk of eye, face, dental or other bodily injury, including permanent injury, if safety gear is removed or rules are violated.
• Physical exertion, slipping, tripping, falling, or collision with obstacles, walls, or other players inside the arena, including injury caused by the acts or omissions of other participants.
• Choking hazard if gellets are placed in the mouth, possible skin or allergic reactions, and marking, staining or damage to clothing, spectacles or personal items.
• Lighting, sound and other special effects used in the arena, which may affect persons with photosensitivity, epilepsy or breathing conditions.
• Equipment malfunction despite reasonable maintenance and inspection.

I freely, voluntarily, and knowingly assume all such risks, both known and unknown, even if arising from normal game operations. 

2. MANDATORY SAFETY RULES & OPERATIONAL DO’S AND DON’TS

I agree to strictly abide by all safety rules, arena signage, and instructions given by Timezone staff. I specifically agree to all the points mentioned in the disclaimer and below:

• Facemask Protocol: Always wear the required full-coverage protective facemask while inside the arena. I understand that removing, lifting, or adjusting my mask inside the arena is strictly prohibited and will result in immediate removal from the game without refund.
• Two-Hand Grip: Keep both hands on the blaster handles during gameplay (blasters are designed to disable when a grip is released; however, I will not rely on this feature).
• Safe Proximity Distance: Maintain a minimum distance of 5 feet (1.5 metres) before firing at another player.
• No Roughhousing: Refrain from running, physical contact, climbing on arena obstacles, or aggressive play.
• Age Limit: I confirm that Gel Blaster mode participants are at least 12 years of age or older. Children aged 6 years to below 12 years may play only Laser Tag mode, if offered by Timezone.
• Equipment: I will not tamper with, modify or remove blasters, facemasks or gellets from the arena, and I will pay for loss of or damage to equipment caused by my (or my minor’s) misuse.
• Removal: Timezone staff may stop a game, or remove any participant, at their discretion for safety or rule violations, without refund.
• Injury Reporting: I will report any injury, however minor, to the Fun Squad immediately and before leaving the venue and will cooperate in completing an incident report.

3. RELEASE OF LIABILITY & INDEMNITY

In consideration of being permitted to participate in Gel Blaster activities at Timezone:

• I, on my own behalf and on behalf of my minor child(ren), heirs, legal representatives and assigns, hereby release, waive, discharge, and hold harmless the Released Parties from any and all liability, claims, demands, or causes of action for personal injury, illness, disability, death, property damage, or loss (including claims arising from the ordinary negligence of any Released Party, the use of equipment, or the acts or omissions of other participants) arising out of my (or my minor child's) participation in the attraction.
• I agree to indemnify and hold harmless the Released Parties against any losses, liabilities, damages, claims, or costs (including reasonable legal fees) incurred due to my failure (or my minor child’s failure) to follow safety rules and staff directions, any breach of this Agreement, any false or incomplete declaration, or any claim brought by my minor child or any third party arising from our participation.
• Where I sign on behalf of a minor, I confirm that I am the parent or legal guardian with full authority to do so. I understand that a minor may not be personally bound by this Agreement, and I therefore agree that my indemnity above covers any claim made by or on behalf of the minor.
• To the maximum extent permitted by law, the total liability of the Released Parties, if any, shall not exceed the amount paid for the Gel Blaster session, and the Released Parties shall not be liable for any indirect, special or consequential loss.
• Nothing in this Agreement excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for gross negligence or wilful misconduct.

4. FITNESS TO PARTICIPATE & EMERGENCY MEDICAL CONSENT

• I affirm that I am (and my minor[s] are) in good health, physically fit, and free of any medical conditions (e.g., pregnancy, heart conditions, high blood pressure, severe asthma, epilepsy or seizures, other neurological disorders, recent surgery or injury, back or neck problems, eye conditions, or sensitivity to flashing lights) that could impair safe participation.
• I confirm that I am (and my minor[s] are) not under the influence of alcohol, drugs or any intoxicating substance.
• I understand that Timezone does not carry out any medical screening and relies entirely on my declaration. If my declaration is false or incomplete, the Released Parties shall have no liability for any resulting injury or loss.
• In the event of an emergency, injury, or medical event during the activity, I authorize Timezone staff to seek first aid or emergency medical treatment on my/my minor’s behalf. I understand that Timezone staff are not medical professionals and that first aid is provided on a best-effort basis. I agree to bear all costs of any medical treatment and transport. 

5. DURATION & GOVERNING LAW

• Duration: This waiver shall remain valid and binding for all Gel Blaster activities at Timezone facilities for the current calendar year or until revoked in writing, whichever is earlier. Any revocation applies only to future sessions and does not affect this Agreement for sessions already undertaken. I will inform Timezone of any change in my (or my minor’s) health before each session.
• Governing Law: This Agreement (Waiver) shall be governed by and construed in accordance with the laws of India, and any disputes shall be subject to the exclusive jurisdiction of the competent courts at Mumbai, Maharashtra.
• Electronic Execution: This Agreement (Waiver) may be accepted and signed electronically. An electronic signature or click-acceptance shall be valid and binding under the Information Technology Act, 2000.
• Data Consent: I consent to Timezone collecting, storing and processing the personal data in this form (including that of my minor[s]) and CCTV footage of the arena for registration, safety, incident management and legal compliance, in accordance with Timezone’s Privacy Policy and the Digital Personal Data Protection Act, 2023.
• Severability & Entire Agreement: If any provision of this Agreement (Waiver) is found unenforceable, it shall be enforced to the maximum extent permitted and the remaining provisions shall continue in full force. This Agreement, together with the Gel Blaster Terms & Conditions, is the entire agreement on this subject.
